Terms & Conditions

Prior to any event that is booked with Exceed Events Limited (EE), the client must agree to Exceed Events Terms & Conditions. A copy of these Terms & Conditions can be found below and are also sent with each order confirmation email. Exceed Events relates to any employee, director or sub-contractor who is working on behalf of Exceed Events Limited.

Payment

To secure your booking we require a 20% non-refundable deposit. By paying this deposit you are agreeing to the terms and conditions outlined below.

Approved payment methods: Paypal // Bank Transfer // Credit/Debit Card

Payment is due in full no later than 30 days prior to the event date. 

This may be made (preferably) via electronic transfer, or alternatively by debit card or credit card. 

Exceed Events reserves the right to cancel the event if payment has not been received in full.

Cancellation

Whether or not payment has been made, if the customer cancels within 30 days of the event there is a 100% cancellation fee. Cancellations outside of this period do not attract a fee however any monies paid are non-refundable.

Cancellations must be made in writing or via email. For audit purposes we will not accept cancellations over the phone.

Inclusions

Exceed Events will supply all products, services and staffing as detailed on the booking confirmation or invoice (if applicable).

We are also covered by public liability insurance of £1,000,000. All electronic items are fully PAT tested and certificates of proof can be provided upon request.

Substitution

Exceed Events reserves the right to substitute a comparable product or service for another in the event of equipment failure or circumstances beyond its reasonable control. This also applies to staff, artists and performers where we reserve the right to change the allocated team member to another should they be unavailable to reasons out of our control.

Drugs and Alcohol

We have zero tolerance to drugs and our staff are advised no alcohol is to be consumed while performing.

Changing Event Dates

Every effort will be made to change the event date if requested by the client, although Exceed Events reserves the right to charge the client if we are to incur additional fees/costs due to the change. The charge may be higher when it has not been possible to cancel subcontractors, venues or if specialist consumables have been purchased. No change may be made to bookings within 30 days of the event date unless approved by Exceed Events.

Performance & Running Times

Agreed performance and running times will be agreed between Exceed Events and you the client at the point of booking. To ensure running times are fulfilled, Scene My Event require access a minimum of 1 hour prior to the start time, unless otherwise specified. We accept no responsibilities where agreed times can’t be fully carried out due to overruns from third parties such as the venue, caterer, client or other suppliers.

Exceed Events always aim to arrive one hour prior to the event start time however we cannot guarantee to attend the venue at the time stated in the Booking Contract due to any circumstances that are out of our control, e.g. adverse weather conditions, heavy traffic, road closure etc. We strive to ensure that all our events run seamlessly, our very best efforts will always be made to deliver the products & services at the time stated on the booking.

Force Majeure

A “Force Majeure Event” occurs where a party is unable to comply with its obligations under this Contract for a reason outside of its control (such as but not limited to, war, fire, death, illness or other capacity certified by a properly qualified medical practitioner, epidemic, pandemic, accident, civil commotion, national calamity, order of Government or Local Authority having jurisdiction in the matter, changes in law, foreign government policy, act of God) and which is not attributable to any act or failure to take preventive action by Exceed Events or client. No liability for any costs or expenses incurred by the customer are accepted by the company in the event of cancellation or postponement. Our maximum liability arising out of or in connection with the non supply of services shall be limited to the total value of the Booking Contract in pounds.

Weather

When bad weather is forecast and an outdoor event is taking place we will advise the best course of action for the placement of our products/services. The majority of our products can only be used indoors or outdoors during clear, dry weather but we do reserve the right to refuse to operate our products if the conditions risk damage to our products. This can also relate to ground conditions which has been a result of the bad weather.

Liability for Damage and Theft 

The customer is liable for theft or damage caused by any guests in their party whilst on the event. All of our products are insured however any excesses and additional costs will be passed to the client if theft or deliberate damage has been caused by them or anybody associated with their event.

Staff Wellbeing & Safety

The wellbeing and safety of our team is of the upmost importance. All team members who are present during your event are there to ensure the smooth running of the products and services that they are operating. If at any point a staff member is either verbally or physically abused, we reserve the right to terminate the service without prior notice in the interest of staff safety, the client is liable for all costs.  

Venue Access, Restrictions and Directions

Where an entertainment service is booked (DJ Production / Magic Mirror Photo Booths), then ground floor access must be available. If your event isn’t being held on the ground floor then either lift or disabled access must be provided. Due to the size and weight of our equipment it is unable to be taken up or down stairs. In the case where we arrive and there is no lift of disabled access to lower/higher floors then we reserve the right under this term and condition to not fulfil the booking and you the client will be liable for all costs.

Exceed Events cannot be held responsible in anyway for any disruption caused by the triggering of any Noise Limiting Devices (environmental noice control system) or power outages caused by such devices at your event which also includes any disruption or quality of performance where we are forced to use any sound system which we have not provided. It is the responsibility of the client to notify Exceed Events of any noise restrictions in place that will affect the booking. The representative of the Exceed Events team on site will set our music just below the DB level at the venue, unfortunately we cannot control ambient noise and that from your guests cheering. These noises can increase the overall room volume which may trigger the limiter, we cannot be held responsible for the limiter should it go off for reasons outside of our control.

We will always work with your venue to ensure a smooth event with maximum impact. Exceed Events however must comply with any direction given by a supervisor or general manager at the venue. In the case where this effects quality or performing times, Exceed Events holds no responsibility.

Dance Floor Hire

It is clients responsibility to inform all guests that drinks are not allowed under any circumstance on the dance floor, particularly with the LED model as this can break the connections between each dance floor panel. With safety in mind spillages can also cause a slippy surface and accidents may happen which we cannot be help accountable for if guests have not followed the guidance on drinks.

Epilepsy

We use a range of different lighting effects at our events which can include strobing and flashing light equipment. It is the clients responsibility to inform us prior to the event if any of your guests attending do have light sensitive epilepsy. 

Copyright 

The company retains rights to images taken on behalf of the customer. Where the customer has paid for photography, the company gives the customer permission to use such images freely but these cannot be used by our competitors or for any purpose which we deem a conflict of interest.  The customer gives the company permission to use images or video taken during the event in company marketing and advertising materials.

English Law

This agreement is subject to English law.

Complaints

In the event of a complaint the client should attempt to rectify the problem immediately with the venue duty manager on the event date. Where this is deemed not possible complaints should then be made in writing, preferably email to Exceed Events within 14 calendar days of the event date. Complaints are treated with the utmost importance, they will be fully investigated and response made available to the relevant party within 7 calendar days.
